Abstract - This is a scientific article focused on the realization of the fundamental right to public security in the democratic state of law. The theme involves public policies related to security and pursues the legal basis to support the way in which the State must act for the realization of social rights, especially the fundamental right to public security. The objective is, in general, to address the problem and in a specific way, considering the State's duties of respect, protection and promotion of fundamental rights, to sustain public policies as an adequate legal instrument for the realization of the fundamental social right to safety in the environment democratic. The research procedure method was bibliographic.
